Welcome to Kodexion. By using our services, applications, and APIs, you agree to comply with and be bound by the following Terms and Conditions. Please review them carefully.

1. Acceptance of Terms

By accessing or using the Kodexion platform, you agree to be legally bound by these Terms and Conditions and our Privacy Policy. If you do not agree to any part of these terms, you may not access our suite of tools.

2. Intellectual Property & AI Models

The technology underlying our services, including but not limited to AI inference scripts, proprietary algorithms, and user interfaces, are owned by Kodexion.

• Outputs: You retain all rights and ownership to the images and texts generated or modified by our tools based on your inputs. We claim no ownership over the resulting media.
• License to use: You are granted a non-exclusive, non-transferable license to use our platform strictly for intended purposes. Scraping, reverse-engineering, or bypassing API limits is strictly prohibited.

3. User Responsibilities & Acceptable Use

You agree not to use Kodexion for any activities that are illegal, harmful, or violate the rights of others. This includes:

• Processing, storing, or transmitting material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, or inflammatory.
• Engaging in any automated use of the system that could damage, disable, overburden, or impair our servers (e.g., volumetric attacks, botnet activity).
• Distributing malicious code (e.g., viruses, trojans) disguised within files uploaded for AI-processing.

4. API Limits & Fair Usage

We provide free tiers for certain tools entirely as a courtesy to the community. We maintain the right to enforce strict rate limits based on IP addresses and authentication tokens to ensure equitable computing access across all users. Continuous abuse of "free" tiers via proxy switching or multi-accounting will result in a permanent ban.

5. Warranties & Disclaimers

Kodexion relies on state-of-the-art AI infrastructure; however, the services are provided "AS IS". We explicitly disclaim all warranties, whether statutory or implied, including the implied warranties of merchantability and fitness for a particular purpose. We do not warrant that our services will be uninterrupted or entirely error-free.

6. Limitation of Liability

In no event shall Kodexion, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, specifically under the jurisdiction of West Bengal, without regard to its conflict of law provisions.

8. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
